RENTAL AGREEMENT GENERAL TERMS AND CONDITIONS

 „Vetura“ rent a car i turistička agencija d.d POREČ (hereinafter referred to as the Lessor) rents a scooter to the Lessee (hereinafter referred to as the Lessee), whose details are listed on the front page of the contract, under the following terms and conditions:

1.     The Lessee agrees to personally sign the rental agreement and thereby accepts its provisions:

a)    to accept the prices and other rental conditions stated in the valid price list as an integral part of the contract,

b)    to possess a valid driver's license and experience in riding scooters,

c)     to receive the scooter in good condition along with all necessary accessories and documentation,

d)    to return the rented scooter within the time specified on the front page of the contract or earlier upon the Lessor's request,

e)    to request the Lessor's consent 24 hours in advance for extending the agreed rental period,

f)     to properly maintain and safeguard the scooter during its use,

g)    not to use the rented scooter:

·         under the influence of alcohol or drugs,

·         for illegal purposes,

·         for driver training,

·         for participation in motor sports events,

h)    to use the scooter exclusively for personal purposes or to allow another person authorized by the Lessor to use it, provided that the person has a valid driver's license, is listed in the "additional driver" section of this contract, and has experience in riding scooters,

i)      to ensure the scooter is operated without exceeding its allowed maximum weight (load capacity), including both cargo and additional passengers,

j)      not to exceed the defined usage area for the rented scooter:

·         Scooters with a power of 50 ccm may only be used within the city where they were rented (e.g., a scooter rented in Rovinj cannot be used to travel to Poreč, Pula, or other cities).

·         Scooters with a power of 125 ccm may only be used within the rental region (e.g., a scooter rented in Istria cannot be used to travel to Rijeka, Slovenia, or Italy)

k)     not to use the rented scooter on highways or express roads,

l)      not to make any alterations to parts, components, or devices on the scooter without the Lessor's consent,

m)   to bear the cost of consumed fuel,

n)    to use the scooter exclusively on paved roads (excluding gravel, dirt, forest trails, or any other unpaved surfaces),

o)    to pay a one-time cleaning fee of €8 if the scooter is returned in a dirty condition.

2.    By violating any provision of Clause 1, the Lessee agrees to compensate the Lessor for any and all damages resulting from such a violation, as determined by the Lessor.

3.     The Lessee agrees to immediately pay the Lessor upon request:

·         the daily rental fee for the rented scooter as per the valid price list and deposit,

·         the fines imposed against the Lessor related to the use of the scooter due to the Lessee's fault (e.g., traffic violations, including procedural costs).

4.     If the Lessee fails to pay the rental costs within the agreed term, the Lessor reserves the right to charge default interest.

5.     In case of non-payment of costs incurred under this contract, the Lessor will initiate legal proceedings against the Lessee to recover its claims.

6.     The Lessee is insured under the applicable regulations and insurance policies for liability protection towards third parties.

7.     The Lessee is liable for any actual damages to the scooter caused during its use. Upon entering into the rental agreement, the Lessee deposits an amount specified in the valid price list to cover any potential damages. This amount will be refunded upon the scooter's return if no new damages are detected.

8.    The Lessee is responsible for all damages caused to the scooter by the Lessee or an authorized driver,

9.    The Lessee is responsible for damages resulting from the scooter being out of use (standing) during repairs, for a maximum of 30 days, and in such cases, must pay a daily compensation fee of €10,

10.  The Lessor will not compensate the Lessee for the loss or damage of personal luggage or goods stored in or on the rented scooter,

11.  The Lessor will not compensate the Lessee for damages arising from:
a) delays in delivering the scooter,
b) any mechanical failures of the scooter during its use.

12.  The Lessee agrees to protect the Lessor's and its insurer's interests in case of an accident by:

a) recording the names and addresses of participants and witnesses (European Accident Report),
b) not abandoning the damaged scooter until it is moved from the accident site and secured,
c) immediately notifying the Lessor's office of any damage, even minor,
d) calling and waiting for the arrival of traffic police for an official report in the event of significant damage or injuries, even if the fault lies with others,
e) submitting a written accident report to the Lessor's office.

13.  If the Lessee fails to comply with the requirements of Clause 12 in the event of an accident, they will be held liable for all consequences and damages incurred by the Lessor as a result.

14.  Any amendments to this contract will be valid only if confirmed in writing by both parties.

15.  In case of disputes, the contracting parties agree on the jurisdiction of the court in the Lessor's registered office location.

16.  If the Lessee pays the rental costs by credit card, their signature on the original contract authorizes the Lessor to charge the rental costs to the issuing organization of the credit card.

17.  If the Lessee is a legal entity, it must pay rental costs within 8 days of the end of the rental period or the expiration of the monthly rental period.

18.  If the Lessee returns the scooter before the agreed rental period ends, no refunds or credits will be issued for unused days. The rental period and corresponding fees are fixed once agreed upon. The Lessee may extend the rental period and pay for additional days as needed. However, early returns will not qualify for refunds or credits for unused days.

19.  The reservation deposit is refundable if the cancellation occurs 48 hours before the scheduled pick-up time.

20.  Before signing the Rental Agreement, ensure you have read its provisions, including all applicable fees and chosen insurance. Inspect the scooter to confirm it is free of damage, then sign the confirmation.

By signing, the Lessee consents to the use of their personal data for scooter rental and payment purposes.
